Read this carefully before going online. These terms govern your relationship with ZyoroRyde when you provide Bike, Auto, Cab, and Parcel services via our platform.

Terms & Conditions for Pilots (Bike, Auto & Cab)

Introduction

This electronic record is per the Information Technology Act, 2000. ZyoroRyde (“Company”, “we”, “us”, “our”) provides a technology-based Software-as-a-Service (“SAAS”) discovery platform that enables lead generation for Pilots who offer:

  • Transportation Services via two-wheelers (“Bike”), three-wheelers (“Auto”), and four-wheelers (“Cab”).
  • Package Services (pickup and delivery of parcels).

Collectively the “Services”. Offerings (including payments) are provided via our website and the “ZyoroRyde” mobile app (the “Platform”). By registering and using the Platform you confirm you’ve read and accepted these T&Cs.

I. General Covenants

  • You are at least 18 years old and legally permitted to provide Services.
  • You’ll comply with these T&Cs and all applicable laws/regulations.
  • You authorize identity/background verification as per our Privacy Policy.
  • You’ll provide accurate, complete and up-to-date information at all times.
  • These T&Cs are binding legal obligations during your use of the Platform.

II. Registration & Use of the Platform

Onboarding requires documents per law and ZyoroRyde policy. You confirm that:

  • You have ≥ 2 years of driving experience.
  • No ongoing proceedings or convictions in the past 3 years for DUI or cognizable offences.
  • All traffic fines relating to your vehicle are cleared before joining.

You must create and safeguard your account. You’re responsible for all activity on it. If credentials are compromised, notify ZyoroRyde immediately. Street-hailing off-platform is prohibited. Do not open or tamper with packages. Calls may be monitored/recorded for quality and safety.

III. Pilot’s Conduct

  • Do not repeatedly refuse Service Requests without valid cause.
  • Follow all applicable Indian laws and ZyoroRyde rules.
  • No account sharing/transfer, illegal use, harassment, intoxication, or app tampering.
  • No content that is unlawful, obscene, discriminatory, infringing, or harmful.

Operational requirements:

  • Max 12 working hours/day with 10 hours mandatory rest.
  • Police verification/KYC, training (≥30 hours) and periodic refreshers as required.
  • Medical fitness (including vision) at company-designated facility.
  • Random inspections for compliance; keep vehicle and documents valid.

IV. Payment Terms

ZyoroRyde may levy fees (taxes apply). We collect convenience fees for enabling access to Services on the Platform. We are authorized to receive Fares on your behalf. If you collect cash, our convenience fee will be adjusted during settlement.

V. Representations, Warranties & Undertakings

General (Pilot & Company):

  • Each party has the legal capacity to perform obligations under these Terms.
  • No conflict with laws, orders, or existing agreements.
  • No criminal convictions for moral turpitude offences.

Pilot-specific:

  • You are duly authorized to operate the Vehicle and provide Services.
  • All licenses/permits/approvals are valid and kept current.
  • You comply with the Motor Vehicles Act and other applicable laws.
  • No DUI/serious criminal convictions in the last 3 years.
  • You carry valid RC/insurance, follow traffic laws, and keep professional standards.
  • No weapons/hazardous materials; no extra payments beyond the app fare.
  • No fraud (false info, fake trips, document tampering, app manipulation, multiple fake accounts).
  • Only one pillion rider is permitted on a Bike.
  • Report prohibited/suspicious parcels immediately.
  • GST self-status: income below ₹20,00,000; inform Company if it changes.

VI. Nature of Relationship

You act as an independent contractor. These Terms do not create partnership, agency, franchise, or employment. You cannot bind ZyoroRyde.

VII. Pilot Information

We collect and process Pilot Information (KYC, vehicle docs, DL, selfie, bank, location, etc.) for verification, safety, compliance, operations and improvement as per our Privacy Policy. Information may be shared with authorities/third parties per law for disputes, incidents, or investigations.

VIII. Confidentiality Obligations

Treat all non-public information obtained via the Platform as confidential (customer data, business info, systems, strategies). Do not disclose/share/sell except as authorized. Obligations survive termination.

IX. Intellectual Property Ownership

ZyoroRyde (or its licensors) owns all Platform IP (design, code, brand assets). You receive a limited, revocable, non-transferable license to use the app on one personal device for providing Services. Your provided information remains yours, but you grant ZyoroRyde a license to use it to operate/improve the Platform and to create anonymised Aggregated Statistics.

Prohibited: sublicensing, selling access, derivative apps, reverse engineering, scraping, or heavy automated use.

X. Indemnification

You will indemnify ZyoroRyde and its affiliates against claims/losses arising from your breach of these Terms or laws. ZyoroRyde may assume defence/control; you’ll cooperate fully.

XI. Disclaimers

The Platform and Services are provided “as is” without warranties (express or implied). We do not guarantee uninterrupted availability, error-free operation, or suitability for a particular purpose.

XII. Limitation of Liability

To the extent permitted by law, ZyoroRyde is not liable for indirect, incidental, punitive, or consequential damages. Total liability under these Terms will not exceed INR 1,000.

XIII. Termination

We may immediately suspend/terminate for breach, misuse, false information, legal/operational/reputational risk, or other reasons listed in your original text. Upon termination: access is revoked; dues are settled; Company assets/data must be returned; you must cease holding out as a ZyoroRyde provider.

XIV. Legal Jurisdiction & Dispute Resolution

Indian law applies. Disputes: amicable discussion → if unresolved within 15 days, arbitration under the Arbitration and Conciliation Act, 1996; single arbitrator; venue Guwahati; language English/Assamese. Courts at Guwahati have exclusive jurisdiction.

XV. Transfer of Rights & Obligations

You may not assign your rights/obligations without prior written consent. ZyoroRyde may assign to affiliates/third parties at its discretion.

XVI. Policy Modifications

We may update these Terms at any time. Material changes will be reasonably notified. Continued use after posting means acceptance.

XVII. Validity of Terms

If any provision is found unlawful/invalid, it shall be severed without affecting the remainder, which stays in force.

XVIII. Insurance Coverage

ZyoroRyde may, at its discretion, offer accident insurance during active service windows. Payouts, if any, may be recoverable depending on circumstances.

XIX. Official Communications

We may notify you via in-app notices, email, or physical mail to your registered address.
